Required Elements for a DMCA Takedown Notice
To be effective, your DMCA notice must be a written communication that substantially includes the following six (6) elements, pursuant to 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the exact URL/link(s) of the infringing content).
- Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, preferably, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Failure to include all six items may result in your DMCA notice being deemed invalid and your request not being processed.
Counter-Notice Procedure
If you are a user whose content was removed due to a DMCA notification and you believe that the content was removed or disabled by mistake or misidentification, you may send a counter-notice.
The counter-notice must also comply with the requirements of 17 U.S.C. § 512(g)(3). We will provide details of the counter-notice procedure to the affected party if their content is removed.
We will investigate all complete and valid notices and take appropriate actions, which may include the removal or disabling of access to the allegedly infringing material.
